1. Acceptance of Terms

Welcome to My Precious ("we," "us," or "our"), operated by Reme path, LLC, a Wyoming limited liability company. By accessing or using our website and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

My Precious is a digital memorial platform that allows users to purchase and seal unique digital puzzle pieces. Each piece is associated with a unique numeric identifier and may contain an image and text. Once sealed, content is preserved and publicly visible for as long as the Service operates.

Key features of the Service include:

• Purchase of unique numeric puzzle pieces for a one-time fee of $4.99 USD
• Upload of an image (optional) and text (up to 5,000 characters) to your piece
• Public display of sealed content on an infinite puzzle canvas
• Search functionality to find sealed pieces by number or text
• Content reporting and moderation

3. Eligibility

By using the Service, you represent and warrant that:

• You are at least 18 years old, or the age of majority in your jurisdiction
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Service under applicable laws

The Service is not intended for children under 13. We do not knowingly collect personal information from children.

4. Accounts and Access

My Precious does not require user accounts. You do not need to register, provide an email address, or create a password to use the Service. When you purchase a piece, you receive a one-time claim token that allows you to upload content within 24 hours of purchase.

You are responsible for keeping your claim token secure. We are not responsible for any loss or unauthorized use of your token.

5. Purchases and Payments

5.1 Pricing

Each puzzle piece costs $4.99 USD. Prices are inclusive of any applicable taxes unless otherwise stated. We reserve the right to change prices at any time, but changes will not affect purchases already completed.

5.2 Payment Processing

Payments are processed through our third-party payment provider, Airwallex. By making a purchase, you agree to Airwallex's terms of service and privacy policy. We do not store your full credit card number or other sensitive payment details on our servers.

5.3 Piece Availability

Piece numbers are available on a first-come, first-served basis. Once a number is sealed, it cannot be purchased again. If a piece is removed due to a content policy violation, the number may become available for purchase again.

5.4 Claim Token Expiry

After purchase, you have 24 hours to upload content and seal your piece using your claim token. If you do not complete the sealing process within 24 hours, the token expires and the piece number becomes available for purchase again. Expired tokens are not refundable.

6. Content Policy and User Content

6.1 Your Content

When you seal a piece, you may upload an image and text ("User Content"). You retain ownership of your User Content. By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, display, and distribute your User Content in connection with the Service.

6.2 Content Rules

You agree not to upload User Content that:

• Violates any applicable law or regulation
• Infringes on the intellectual property rights of others (copyright, trademark, right of publicity, etc.)
• Contains pornography, sexually explicit content, or nudity
• Contains violence, gore, or self-harm content
• Promotes hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristic
• Promotes illegal activities, drugs, gambling, or terrorism
• Contains personal information of third parties without their consent
• Contains malware, viruses, or harmful code
• Is spam, misinformation, or deceptive content

6.3 Content Moderation

We reserve the right to review, remove, or hide any User Content that violates these Terms or our Content Policy, in our sole discretion. We may also release the associated piece number for re-purchase. Content that is removed due to policy violations is not eligible for a refund.

Users may report content they believe violates our policies. We review reports and take appropriate action.

6.4 Immutability

Once sealed, User Content cannot be modified or deleted by the user. This is a core feature of the Service — "a moment, forever." Content may only be removed by us for policy violations or as required by law.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its design, layout, graphics, logos, and software, is owned by My Precious and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.

7.2 Your Intellectual Property

You retain all rights to your User Content. You represent and warrant that you own or have the necessary rights to upload your User Content and grant the license described in Section 6.1.

7.3 DMCA and Copyright Infringement

If you believe your copyrighted work has been infringed on the Service, please contact us with the following information:

• A description of the copyrighted work you claim has been infringed
• The piece number or URL where the infringing content is located
• Your contact information (name, address, phone number, email)
• A statement that you have a good faith belief that the use is not authorized by the copyright owner
• A statement that the information in your notice is accurate, under penalty of perjury
• Your physical or electronic signature

8. Prohibited Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service, its servers, or systems
• Interfere with or disrupt the Service or its servers
• Use automated systems or bots to access, scrape, or interact with the Service
• Attempt to purchase or seal multiple pieces using fraudulent payment methods
• Impersonate another person or entity
• Harass, abuse, or harm other users
• Use the Service to transmit malware or harmful code
• Reverse engineer, decompile, or disassemble the Service

9. Service Availability and Changes

We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free access. The Service may be unavailable due to maintenance, technical issues, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

While sealed content is intended to be preserved for as long as the Service operates, we cannot guarantee perpetual preservation in the event of service discontinuation, business closure, or other circumstances beyond our control.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free, or that any defects will be corrected. You use the Service at your own risk.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MY PRECIOUS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service
• Any content uploaded by users, including content that violates these Terms
• Unauthorized access to or alteration of your transmissions or data
• Service interruptions or downtime
• Any other matter relating to the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID FOR THE PIECE(S) AT ISSUE ($4.99 USD PER PIECE).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. Accordingly, some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless My Precious, its affiliates, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any provision of these Terms
• Your User Content, including any infringement of intellectual property rights or violation of applicable laws
• Any claim that your User Content caused damage to a third party

13. Refunds

Please refer to our Refund Policy for detailed information about refunds. Generally, purchases are non-refundable due to the digital nature of the Service, except in limited circumstances described in the Refund Policy.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. The Service is operated by Reme path, LLC, a Wyoming limited liability company.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Wyoming. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Content Policy, constitute the entire agreement between you and My Precious regarding the Service and supersede all prior agreements and understandings.
